As mentioned in last week's TAXVINE, at the most recent ATO National Tax Liaison Group meeting, the Taxation Institute raised concerns in relation to the process of applying the accountants’ concession. Common areas of concern include:

ATO audit staff interpreting and administering the accountants' concession on a consistent basis;
Escalation procedures where parties disagree with the ATO audit staff decision/approach; and
Practicalities of claiming the concession (ie the forms).

To progress this issue, the ATO has asked the Taxation Institute for specific practical examples of where there have been problems in relation to the accountants’ concession.

With this in mind, we ask Members to please provide examples of problems they have encountered when seeking to claim the accountants' concession. The examples can be provided on a "no-name" basis. However, there would need to be sufficient details around the particular issue involved to allow the ATO to independently confirm that the issue is a systemic issue and then consider methods for rectifying the issue.
