On 23 February 2015, Joanne Dunne CTA (Minter Ellison) and Niv Tadmore CTA (Clayton Utz) attended a meeting of the ATO Dispute Resolution Working Group. In summary:
- The group discussed how independent review should be conducted in relation to transfer pricing matters. Various options were discussed and there will be further consideration of this issue.
- The ATO is drafting a Charter for disputes. A draft of the document was discussed by the group and amendments to simplify the wording were proposed. Further amendments may be made to incorporate any recommendations from the report of the House of Representatives Tax and Revenue Committee’s Inquiry into Tax Disputes, which is likely to be released in March 2015.
- The ATO circulated a copy of the ACJI’s report on the Australian Taxation Office's use and the effectiveness of ADR strategies.
