01 Jul 10 Legislation expands tax ruling regime
On 30 June 2010, the ATO sent a broadcast message to tax agents advising that Tax Laws Amendment (2010 GST Administration Measures No 2) Bill 2010 received Royal Assent on 28 June 2010, expanding the general ruling system to include excise, goods and services tax (GST) and other indirect taxes from 1 July 2010.
For indirect taxes, only publications gazetted or labelled as public rulings before 1 July will be public rulings from 1 July. Previously, more publications than this were public rulings for indirect taxes. This means that some existing publications that were public rulings cease to be public rulings from 1 July and become guidance instead. Guidance can still be relied on and can provide protection against interest and penalties, but not tax as public rulings do.
