21 Nov 14 More on "heavy-handed" ATO correspondence

MEMBER 187 writes: 

"A staff member has received a letter from the ATO advising that the interest claimed of less than $1,100 on a rental property 'may be incorrect' and that if no response is made to the letter within around 28 days the deduction will be disallowed and an amended assessment will issue. 

A phone call to the ATO revealed that all taxpayers claiming interest on rental properties will receive this letter. 

The staff member’s issue is with the words 'may be incorrect' when the ATO has not requested evidence to check the facts and she believes that the ATO has abused its powers by saying it may be incorrect without evidence. A complaint as to the issue is being made by the staff member.

Interesting to know if clients of other members are receiving such letters."
