Gina Lazanas (Balazs Lazanas & Welch LLP) and Sue Williamson (Clayton Utz) attended the inaugural meeting of the NTLG Dispute Resolution Sub-committee on Tuesday 28 June 2011 as The Tax Institute’s representatives. The Sub-committee was established to provide a forum for consultation to develop dispute resolution strategies which encourage parties to focus on prompt resolution of disputes and to avoid or minimize the scope of litigation. It is different to other NTLG Sub-committees in that it will not focus on technical tax issues but on behaviours and processes. For example, the matters to be discussed at this forum include the ATO’s approach to resolving disputes, the Commissioner’s obligation to act as a model litigant and early dispute resolution strategies. The first meeting, attended by senior ATO officers as well as representatives of the Federal Court and NADRAC, and a leading academic, amongst others, was very productive. External members also took the opportunity to share their experiences in the spirit of laying the foundations for improvements in the early resolution of tax disputes.
The Tax Institute welcomes this initiative and strongly supports the ATO’s efforts in striving to enhance a resolution culture both inside the ATO and amongst tax practitioners.
