16 Nov 12 NTLG Dispute Resolution Sub-committee
On Monday 12 November 2012, Gina Lazanas CTA (Balazs Lazanas & Welch LLP) and Dr Niv Tadmore CTA (Clayton Utz), represented The Tax Institute at the NTLG Dispute Resolution Sub-committee meeting.
The topics discussed included the ATO Dispute Management Plan and Disputes Policy that were released on 30 October 2012 and other initiatives that the ATO is implementing with respect to encouraging the use of early dispute resolution processes.
One of these is the new ATO pilot on in-house facilitation to resolve smaller and less complex indirect tax objections. Another is the training that is being provided to the various business lines to raise awareness of the responsibility of the ATO as a government agency to take genuine steps to resolve or clarify disputes as early as possible, including both before and throughout legal proceedings.
There was also some discussion around the rewrite of Law Administration Practice Statement 2007/23 re Alternative Dispute Resolution and the drafting of a new ATO Plain English Guide to Dispute Resolution, both expected to issue in 2013.
Other issues discussed included the utility of ATO Decision Impact Statements and proposed changes to the procedures and forms being used with respect to legal professional privilege claims.
