"I have so far received 4 letters from the ATO advising of proposed amendments to reverse the Education Tax Rebates that were claimed in clients' 2009 income tax returns. In all cases the client did not claim fortnightly FTB part A payments from the FAO and probably did not bother to submit an annual claim for the benefit from the FAO. According to the ATO if the client has not made a claim for FTB part A then the client is not entitled to the Education Tax Rebate and basically the ATO does not care and will amend the return. I have told the clients that they need to contact the FAO and have an assessment for FTB issued, so that I can submit an explanation to the ATO. This is another example of maladministration by our fearless ATO."
