MEMBER 56 writes, in response to Member 41's comments in last week's TAXVINE - see 2012 TAXVINE No 7 (9 March 2012) - about arbitrary assessments following lengthy delays involved in the "12 week review" process:
"In response to Member 41, I have had almost the identical issue with 2 clients and the '12 week reviews' in that they have finally come back after 6 months with amendments and no reasoning at all. They both had a contact name though, and I was advised to contact the ATO switchboard on 132869 and ask for that person. In both instances I spoke to the correct person and they advised the reasons for amendment. I then had something to object about which I have now done (all they needed was further info) and have to wait a further 2 months etc, when a 5 minute call from the person reviewing the case would have finalised it. Good luck!"
THE TAX INSTITUTE'S TAX COUNSEL, STEPHANIE CAREDES, COMMENTS: "Member 41's matter has already been taken to the ATO by The Tax Institute and the ATO is responding. To Member 56 and to other members experiencing the same difficulties in progressing these matters that have arisen as a result of the ATO's refund review process, please forward details through to TaxPolicy if you would like The Tax Institute's assistance to progress your matter with the ATO as the ATO is also willing to resolve these matters."
