ATO response: 

We are aware that there were issues preventing the successful lodgment by some users of their SG contributions via the SBSCH during the last quarterly SG lodgment period. These matters arose in part from fund initiated merger activity and some Fund Validation Service (FVS) errors. 

We provided updated details to those clients who contacted us once the issue had been identified. At the same time we published advice on our SBSCH system status page for users who were affected by this merger activity and were not able to make their SG payments by the 28 April due date. 

That published information confirmed we would apply principles in PS LA 2007/1 and not apply a superannuation guarantee charge to employers that were impacted by the merger activity subject to the following: 

The employer:

  • had funds available to pay their SG liability by the 28 April 2019 due date
  • has evidence that they sought to make a contribution on behalf of the employee within the appropriate timeframe and
  • made the payment promptly once the SBSCH system or access issues were resolved.

We are currently looking at our processes and procedures in relation to future fund initiated merger activity and changes to the FVS with a view to mitigating the chance of these types of issues occurring again.
