19 Mar 1010 Tax Practitioners Board Consultative ForumCEO Noel Rowland participated in the first Tax Practitioners Board Consultative Forum on Tuesday, 9 March 2010. Issues discussed included the Tax Practitioners Board's communications strategy, what is a tax agent service, complaints processes, education requirements, professional indemnity insurance, specialist/restricted registrations and unregistered preparers.
As expected there was a significant discussion about what is a tax agent service and accordingly who is required to register. The Taxation Institute firmly put the view that tax advice is tax advice and there is no such thing as incidental tax advice. The Tax Practitioners Board indicated their view (as advised on the Tax Practitioners Board website) that registration was required for anyone providing a tax agent service for a fee and where that advice is reasonably expected to be relied on. The Tax Practitioners Board noted the issue of who is covered by the new regime is a policy matter for Government and they were expecting some clarity would shortly be provided.
