Taxation Administration Act 1953 (Meaning of End Benefit) Instrument 2013 was made on 28 November 2013 and registered on the Federal Register of Legislative Instruments on 5 December 2013 as Legislative Instrument 2013 No F2013L02050.
This instrument excludes family law superannuation payments from the definition of "end benefit", thus excluding these payments from triggering liability to pay any deferred Division 293 tax amount.
Division 293 tax is charged at 15% of an individual’s taxable concessional contributions above the $300,000 threshold (which are capped for 2012–13 at $25,000).
