This article examines the question of the capital and revenue distinction as it applies to MITs, suggests that London Australia may not necessarily be the answer. It also highlights the inability of Division 6 to cope with modern commercial practices and questions whether the proposed “MIT Tax regime” will resolve these two key contemporary issues.
