Tax Tips: Creating a capital loss – a recent UK experience

A decision of the UK High Court handed down in January 2008 is of considerable interest to practitioners where a capital loss is sought to be crystallised. The decision is also significant in relation to the issue of whether there is a “set-off” in particular circumstances.
